DISCRIMINATION AND ITS IMPACT IN INDIA TODAY

INTRODUCTION

The caste is one of the differentiation where the people in India are being separated by their class, religion, colour, language, gender. Although there are some other means of differentiation like wealth, power, etc. Caste is the major one that overlaps all other factors which exist. Though many laws restrict discrimination against caste, sex, religion it's not fully followed until now there are many recent issues where many people are discriminated against. Taking a recent issue was the Panjayat president in Cuddalore who was discriminated against in their assembly which was going on in recent days. After seeing this question arose whether in 2020 people are still following these kinds of activities. According to Article 14,15 and 16, no person shall be discriminated against their caste and every person should be treated equally without any discrimination if they didn't follow such they will be punished accordingly. There is punishment no person is obeying. So the matter of caste and discrimination must be taken into account and there should be strict laws to be implemented who do not follow and they have to be punished immediately.

RESERVATION

After this, there comes a major factor called "reservation". Reservation plays a major role in every part of life. Reservation has been implemented because of uplifting many people who are facing discrimination. I accept it is important in those days but I strongly contend that reservation should be totally abolished and every person should be treated equally or else reservation should be given only to social and economic backward people other those should not be given because they are already uplifted so why should we have to give reservation to those people.

The framers of the constitution aimed toward establishing a casteless and classless society. They are geared toward uplifting the downtrodden section of the society and providing them with a dignified life by focusing upon their employment, education and status. Thus, in an exceeding nutshell, the inspiration for the concept of reservation was embedded into Equity and Justice. However, with time the whole got derailed from its track. Thus, after reviewing various dimensions of the reservation policy of the government protected under Article 15and 16 several shortcomings of reservation policies are brought into the notice. To eradicate those flaws and to realize the specified goals of reservation policy, the authors’ humble suggestions could also be considered as follows: A constitutional amendment is required to clear the anomaly of the term “backward class” as mentioned in Article 15 and 16. Several times these expressions make confusion because women, children, and persons living below the personal income are too categorized as a backward and weaker section. Therefore, to get rid of this ambiguity an amendment for clarity is predicted. in an exceedingly contest of the availability under Article 320, it often complains that the political parties and also the government in power wanted to sustain the reservations, only for the sake of counting their vote banks. Therefore, it's suggested that this is often the correct time to abolish such sort of reservation by constitutional amendment and to restrain Indian politics from getting contaminated. A scrutinizing approach is required for the precise determination and classification of the creamy layer. Besides it's strongly recommended that the concept of the creamy layer should apply to the elite class of Scheduled Caste and Scheduled Tribes also. It’s also suggested that the scheme of the creamy layer should properly be reviewed with all due intelligence. Although the govt. has introduced the ten quotas for the Economically Weaker Section within the unreserved category hastily this can be the time that the government should revise policy regarding the determination of the poverty level and make sure that all poor and needy are coming under such ambit. And, specifically, the authors suggest that this can be time to specialize in the essential challenge being faced by the Reservation Laws which is nothing else but a faulty mechanism of implementation or execution of Laws or policies being formulated. The particular beneficiary is lacking in knowledge which are some things of utmost concern presently.

CONCLUSION

Regardless of The changes within the caste systems laws, India's economic and political exchanges still stay identical. Although the caste provides order to the people, there are still social inequalities that need to do with a very cheap class. In 1955 a constitution in India was made up to legally abolish "untouchability". This act was started by a man who grew up as an untouchable himself. What class Indian people have or what. It takes plenty to be a leader this man is now referred to as Supreme Court, K.Ramaswamy. He got the courage to talk up for those who couldn't. True leaders strive to create a difference and don't seem to be in it for the celebrity and fortune. Ramaswamy could be a man who was in it for justice. He spoke for people who did not have a say in much, because of the category they were born in. Not only was he a grey leader, but he left a real legacy for his labour for the rights he earned for these unknown untouchables.
